Principle and conditions

Trademarks are the showcase of any company insofar as they designate products and services and distinguish them from those of competitors.

With the internationalisation of markets, increase in the number of offers, modernisation of distribution channels and size of the national market, it is imperative for any company engaged in an international activity to extend the scope of protection of its trademark.

This extension is facilitated by the Madrid System which offers the applicant of a national trademark or owner of an already registered national trademark, the possibility to have the trademark protected in several countries that have signed up to the system by simply filing one application for international registration at the Intellectual Property Division.

Once the international trademark has been registered by the World Intellectual property Organisation (WIPO), it has equal effects in the designated countries to those of an application for national registration filed directly in each of the said countries.

If the Trademark Office of a designated country does not refuse protection within a specified period, the protection of the trademark is the same as if it had been registered by that Office.

The protection covers a period of 10 years, renewable indefinitely.

Registering the trademark from Monaco

The trademark to be registered abroad must have been registered, prior to that, in Monaco or at least be in the course of registration at the Intellectual Property Division.

Getting a cost estimate

To know the amount of duties payable, the applicant may, as per its choice, visit the website of WIPO - fee calculation  or contact the Intellectual Property Division to get an estimate.

The duties payable are expressed in Swiss Francs. Duties are payable directly by the applicant to the Finance Department of  the WIPO - bank account .

Obtaining and completing the form

The form - MM1, MM2 or MM3, as per the choice – for the international registration of the trademark, as well as information for filling them in, are available from the website WIPO - Forms .

Submitting the form

The form, duly signed and dated by the applicant, must be submitted to the Intellectual Property Division, which will, after examination, forward it to the WIPO International Bureau.

This form must be accompanied by a cheque of €29.00, made out to the Public Treasury, for the processing of the international application by the Intellectual Property Division, and two reproductions of the trademark where it is figurative or semi-figurative.
